Three Strikes Reform Act of 2012 (Proposition 36)
  Overview
The Three Strikes Reform Act of 2012, also known as Proposition 36, restores the original intent of the Three Strikes law by requiring that life sentences be imposed for serious or violent crimes. This means that some people currently serving life on a three strikes sentence could see their sentences shortened and ultimately be released.
You can find the official language of the Three Strikes Reform Act of 2012 at California Penal Code section 1170.12.
The Kern County Public Defender's Office has already pre-evaluated and pre-screened hundreds of cases pursuant to Proposition 36, and we are currently filing petitions for resentencing.
  Who is eligible for resentencing?
You are not eligible to be resentenced pursuant to Proposition 36 if any of the following apply to you:

  What is the process for requesting to have a case evaluated for resentencing?
